Is there a permanent parenting plan or other custody order that has been entered by a Court? If not, then pursuant to Tenn. Code Ann. § 36-2-303, you already have full custody of your daughter, and that will not change until a Court orders differently. On the other hand, if a Court has entered a parenting plan or some other order granting the Father visitation rights, then that parenting plan or Court order governing visitation/custody will remain in effect until it is altered by the Court. In order to modify the current court order you will need to file a petition seeking to modify the court order based upon the Father's recent threatening behavior. You should consult with an attorney in order to evaluate your best course of action going forward. Best of Luck!

It appears from your question that you already have full custody. You are not married to the father and I assume never were and father has never taken any steps for custody/visitation then you always have had and will continue to have full custody, absent a court order giving the father any rights. The father can be ordered to pay support without having any rights to visit.

In Tennessee, if a child is born outside of wedlock, generally, custody lies with the Mother. If the Father wants visitation, he will need to Petition the court to establish parentage and visitation.

Unless a court order says otherwise, you have custody.
