I cashed a check at Check Smart and it bounced. Am I responsible to pay this back or is the person who wrote it responsible?

They have tried to put the bad check through 2 more times and no good. They now say I am ultimately responsible for repayment, not the person who wrote the check. What is my personal legal responsibility/ obligation in this matter?

Unfortunately the matter is between you can Check Smart. As to the person who gave you the check you likely have a cause of action against him/her. Generally state law allows a judgment for multiple amount of the check. You can probably file in Small Claims court.

You are responsible for the repayment, however, you can recoup your damages from the person who wrote you the bad check.

Check Smart can go after you as the person who presented the check. You will have to go after the check writer yourself. Utah has a very specific set of rules for handling bad check cases, so you'll want to be sure to do it right.
