Maricopa county, this would be considered senior abuse. Trustee "purchased" an asset in my father's name (he's senile) and then shortly afterwards transferred the asset to herself. I need advise on strategy & to hire an attorney locally, as I do not live in Arizona. I'm looking for an expert on senior financial abuse (fraud) & to file civil suit to contest the will. I need to hire an attorney who works with detectives or prosecutors in Maricopa county that may assist in the criminal case. This is time sensitive & the trustee is pushing to "settle" & distribute the assets.

First, have your Attorney file a Motion to Compel a Fiduciary Accounting from the beginning of her tenure as Trustee to the present (in accordance with Arizona law). Then file a Motion to Replace the Trustee for Wrongful Conversion, Fraud & Breach of Fiduciary Duty. See Find-A-Lawyer at the top of this page.

As you imply, there would be two separate actions. I am happy to meet with you telephonically for a free initial consultation. I represent matters similar to what you have described. I would also be able to point you in the right direction to pursue the criminal action, which would be independent of your civil suit.

I would be happy to discuss the civil/probate side of this matter with you further. You can discuss the potential criminal action with the prosecutor's office, but their own investigation will determine whether any action will be brought. I do offer free initial consultations on these types of cases.
