Is there criminal legal aid before an arrest?
Anonymous5 views4 answers
I have recently been questioned by the police regarding a matter of a missing deposit at my job. I know they were lying to me by the things they were saying. I finally got out of there by asking if I could leave. At this time I would like to get a lawyer but my income is low as I am on suspension from my job. Is there some type of program I can apply for legal help in Fayette County, Kentucky without actually being arrested.
KRS Chapter 31 allows an indigent person charged with a crime to speak to a public defender before charges are filed. Call the Lexington Department of Public Advocacy (your public defender office ASAP). They will be busy, but will eventually take your question if you are persistent. Or, just show up at this office between 8:40 and 4:30 at 163 W Short St Suite 200.
I'm out of town now or I would give you my direct number. I'll be back in on 3/3 if you'd like to stop by.
Every county has some form of public defender program for those who cannot afford to retain counsel in criminal matters. However, such access is not available until the time of the first court appearance.

Do not talk to the police without your attorney being present! Exercise your right to remain silent! If charged and you cannot afford a private attorney ask the court to appoint you a Public Defender at the first court date.
I don't know if you can consult with the PD before being charged in Fayette County, KY. Call their office and seek assistance.
There is no program available for legal aid before a person is arrested. In the long run, it is a good idea to retain an attorney before being charged while an investigation is taking place because the lawyer may be able to keep charges from being filed or limit the severity of the charges.
