I have an abuse of process lawsuit I am seeking to file. As there are “two essential elements” of abuse of process, as “‘a willful act in the use of process not proper in the regular conduct of the proceedings’ and an ‘ulterior motive.’” , both elements necessary for the tort litigation are met, and admitted in open court on February 20, 2014 by the citing officer, as well as the school social worker as a witness, and even the judge of the case.

A person is almost always better off with an attorney. The real question is whether it makes financial sense to do so. You might want to spend $100 on an initial consultation somewhere before you spend lots of time and/or money pursuing the case.

What are your damages? They must be more than just the costs of defending the original suit. There must be some other damages. You need an attorney to explore this part of the case. Your efforts at research are admirable, but the is no case without damages. Use find a lawyer to locate one near you.

The determination of the essential elements of this tort are found in state case law. I am in Florida and have successfully litigated an abuse of process claim, but they are complicated. Check cases in Wisconsin that discuss the elements of the action. These cases are usually the result of successful motions to dismiss the case.
