The statute of limitations was satisfied when the Police Officer handed you the ticket roadside. However, you likely have a constitutional speedy trial claim. You would need to make a formal written motion to dismiss. Cases from the Appellate Term generally say if the delay is more than 2 years the prosecution needs to have a good reason.
