I blew and failed into Drager interlock device, waited 5 minutes as device said and failed again.

I immediately called VASAP caseworker and explained I had used mouth rinse containing alcohol, straying from my usual morning routine because I was running late. I usually do that first thing upon waking. I then went to retest and had 15 minute lock out. I went back inside to make calls to let my clients know I would be late. I got held up and didn't retest for approximately 30 to 45 minutes. I passed test, and had no incidents the rest of the day. What can I expect from this incident?

Having defended many ASAP violation cases, you should seriously consider consulting an attorney about representing you if you are charged with a violation.

Do not to use alcohol-based mouthwash before trying to drive your car, especially when running late. It is hard to say what you could expect from this incident. Of course, the authorities will see that you failed a test, and they are not likely to believe that you failed because of alcohol-based mouthwash (they get that story a lot). I'm not saying that I doubt your story, but I am telling you what to expect. The good thing is that you did retest soon afterwards and pass. That will show them that the failed test could have been an anomaly, not an attempt to drink and drive.

It is good that you immediately contacted your ASAP counselor. If the counselor believes you, they might not issue a violation report.

Many ASAP offices will not issue a show cause violation on only one positive test. However, if you do receive a violation letter, you are facing all of your backup time as well as losing your driving priveleges.
