What do I do ?? Domestic violence
Anonymous7 views2 answers
Me and my girlfriend were staying at a motel , she started arguing with me early in the morning , struck me three times and I grabbed my stuff as quick as I can , check out , the room was in my name ,I didn't call the cops neither did she , the neighbors called the cops and said the were witnesses when it was just me and her in the room , the cops talked to my girlfriend and she said nothing happened, there was no bruises nothing broken , the next day the DA or detective came to her house and said that the state was going to pick up the charges !!! How do I get my story across ? Before it gets worse
Unfortunately State law requires the police officers to file Domestic Violence charges any time they have probable cause to believe a crime occurred. The best thing to do would be to hire an attorney to represent you on the charges in order to avoid the charge from going on your record.
I would not make any other statements to any officer or district attorney until you have hired an attorney.
First off, do not talk to anyone about the case until you get the attorney. The sooner you hire an attorney the better counsel can work to preserve your rights. For example, when domestic charges are filed, the judge will usually order that you have no contact with the alledged victim. An attorney would be able to help convince a judge that the facts in the case does not justify such a restriction. Based on the facts you've laid out, and if your attorney has a good working relationship with DA's office, they could speak to prosecutor about your case and see if they would agree to drop it.
