Do I have to file a medical lien with the state of Tennessee?

I work for a chiropractor's office that is starting to see more personal injury patients. We're having conflicting information from insurance companies stating that we DO have to file a lien with the state, when two months ago they said we didn't. Bullying tactic, or has the law in Tennessee changed?

This is very simple. The patient signs a lien before you treat them. Is that correct? When their lawyer asks for the records or bills, or otherwise makes contact with you, then you inform the lawyer of the lien, and supply a copy of the lien. Are you all doing this? If the lawyer disburses funds to the client/patient without honoring the lien, then you have a cause of action against the lawyer. I practiced personal injury law for 20 years, and have never seen a chiropractic lien filed with the clerk's office. I have occasionally seen a hospital file a lien, and recall reading a statute which gives the hospital powerful rights to proceeds of a case. I think your best option is to work closely with trusted plaintiffs' lawyers and to be reasonable in how you treat and bill your patients.

No generally most chiropractors offices and medical doctors offices do not file a recording type of hospital lien with the clerks office. However if you do it may protect your office to be able to recover proceeds from an uninsured patient but it is not required

If the patients are represented by counsel and you are performing services on a lien basis, the attorney should protect your lien rights. You should contact a local business lawyer to make sure that you are handling lien related cases in a proper manner.
