I was arrested for DWI in 2004. The case was disposed of in 2006, and I plead to DWAI? I'm applying for a position in a state which does a seven year criminal conviction check based on the salary I am making. However, they are a government agency that could go back father if they want. I know that this shouldn't show up either way, but will a DWAI show up as a criminal conviction record check?
Based upon your description of events, you were not convicted of a crime. But, I think it might show up that you were arrested for DWI which is a crime and that the case was disposed by way a of plea to DWAI which is a violation. It depends on the method used to search your criminal history.
Most violations and traffic infractions get sealed after a certain time period in NY. However, DWAI is an exception to this and may very well turn up on another state's background check. You should consider disclosing it so it doesn't look like you're trying to hide it. Remember, it's just a traffic infraction and not a criminal offense.
