I am Malagasy. My husband is American. We got married in Madagascar before coming to live in America. After 19 years of marriage , things did not go well, and we got separated. I think seriously about a divorce. What should I do since we got married in Madagascar? Can I ask for divorce in indianapolis or should I submit my case to the law in Madagascar? I also don t have a great income but still want to know the approximate cost of a divorce in indianapolis.

Do you intend to stay in Indiana after the divorce? Often, marriages in other countries are recognized, but if you want to be legally divorced in the United States, you need to get divorced here. That means, if you want to stay here, or ever intend to get remarried in the United States, you should get divorced in the United States. The cost will depend on if you hire a lawyer, how contested your divorce is (contests about property and children, etc.). In that regard, we cannot provide you with a hard fast number, because there are too many factors that go into that response. You can always use the find a lawyer tab and obtain lawyers' hourly rates and advanced fee requirements (privately, not in this public forum). We always recommend retaining counsel, because there's too much at stake in a dissolution, but if you want to represent yourself, you can fill out the forms found at: http://www.in.gov/judiciary/selfservice/2333.htm, click on Civil (Option 1) to the right, Click Option 2 for Divorce, and follow the prompts. There is also an option for a fee waiver, should you qualify. As mentioned, it is always best to retain counsel to represent your interests, and especially if there is a lot of property or children's issues at stake. However, in the even that is not feasible, read the entire website on information for what to expect during your divorce. I provided the link above for your reference. Best wishes to you.

If you meet the Indiana residency requirement you can file for divorce in Indiana. Whether that is to your advantage or not requires analysis of the difference between the law of Madagascar and the law in Indiana.
