I apply for B2 visa in 11 october 2013 until 1st of may 2014 and now i get the letter from uscis about some more documents they need and i have for that 33 days so even if they approve this Im not gonna have time to apply for h2b so can my Employer apply now if the b2 is still pending ??

Why is taking so long for the change of status application? You should have received a decision by now . Make sure you respond to the request for more evidence ASAP. If not sure how to proceed, hire an immigration lawyer.

Regardless of whether your initial B-2 request is still pending, you MUST either leave or file another change of status request by May 1. Whether or not it's possible to file an H-2 petition before May 1 would be a question for the attorney handling the H-2 petition.
