What legal resources are available to me to fight balance billing and a medical collection agency.

I was balance billed by an anesthesiologist when I had cataract surgery. I went to an in network hospital and used an in network surgeon. The hospital said I didn't have to worry about anesthesiology because the RAP (Radiology Anesthesiology Pathology) Provision protected me. I was balance billed $1291.09 beyond what insurance paid. The billing office told me they just wanted me to help them talk to the insurance company but they sent the bill to collection without warning. What resources are available to me in fighting this?

Sorry to hear about your medical billing problems. There are several different issues that need to be addressed including whether the balance billed by the hospital is correct, whether the insurance company paid the correct amount in relation to your policy, and finally unfair collection practices. It is a possibility that you may have claims under the Texas Deceptive Trade Practices Act and or its federal counterpart in regards to your insurance payment and the collections company practices. However, the exact details of your situation need to be known before a complete legal answer can be given. There are several steps in Texas which you can take against collections companies to stop unwanted harassment and validating that you actually owe a debt. I would highly recommend finding and explaining the exact details of your situation to a local attorney who is comfortable working with hospitals as wells as collections companies. Good Luck.
