I drove drunk, woke up in hospital, do not remember a thing. Police not involved. Does the hospital have to report me to police?

“I was in an accident in Philadelphia. I was drunk and I woke up in the hospital. I have no memory of what happened. Someone at the hospital told me I hit a parked car. I sustained a concussion,& broken ribs. the police were not at hospital and there is not police report of an accident at the two police districts I called. I do not know if the hospital took a blood sample to determine if I was drunk. How do I find out if the hospital took blood? Also, if the hospital did take blood and it shows I was drunk, do they, by law, have to report me to the police? If so, will I be arrested?

You can request your own medical records from the hospital. They might charge a substantial fee for the copies. The hospital is not required to report you to the police. In all likelihood they took blood and tested it for many things including alcohol so they could properly treat you.

This is probably not the type of thing to post on the internet, admitting to committing a crime. If you are concerned consult with a local criminal defense attorney.

Your candor here on avvo is - well lets say - unique , but if the cops weren't at the hospital to arrest you/question you, you stand a fine chance of slipping through the cracks, if not, hire a local criminal defense attorney. I suspect fyi that either the hospital didn't test your blood for alcohol (etoh) right away or they did but you were right below the limit.

You may be arrested for DUI where there is probable cause your drove under the influence. If the hospital took your blood, there may be evidence to convict you. If you receive a summons to appear in court, retain a Philadelphia Criminal Defense Lawyer. Good luck.
