What to do re: insurance (homeowners, flood & auto) for property of deceased parent -- probate not started yet (I am sole heir)
Anonymous7 views2 answers
Parent died in FL (I do not live in FL) I am the sole heir (I inherit the house, all the contents and the car)--plus I have been designated executor in the will
Not sure what to do about the following insurance issues?
-FLOOD INS. (Just expired – two days before death – needs to be renewed and paid for)
-HOMEOWNER INS. (Mortgage is paid off) Policy is currently in effect for the next 7 months and paid in full.
-AUTO INS. Policy is currently in effect for the next 5 months and paid in full.
The estate is not yet in probate even though I have registered the will with the county as required by FL law.
How do I handle these insurance issues?
(Note: I am able and willing to pay the bills but not certain what needs to be done with the insurance companies since I do not officially own the house or the car yet).
Thanks very much!

Hello,
Sorry for your loss.
You may want to let the insurance companies know that your parents have passed and that you are going through probate. Depending on how long it takes for you to get the legal authority to manage these assets, you may want to pay the insurance premiums when they become due again and then you would submit a claim to be reimbursed by your parents estate until title is transferred to you.
You may also want to talk to an agent in Florida about the importance of having the flood insurance and renewing it to protect your asset.
You will want to talk to a Florida probate attorney. An estate will most likely have to be opened to transfer title. An attorney can help you with many of the issues you raised. Also some institutions will not let you do anything without letters of administration. Those can only be issued through probate.
