After my Mom passed, in 2008, ss kept sending her checks, I called them 3 times and told them about the payments, and also sent 2 death cert, the funeral home also sent in a death cert. They kept telling me the money was not coming from the Treasury dept, I told them it positively was, it was right on the deposit, that I was on my Moms account. They told me they had no record of my mother at all, and that the money was most likely coming from the railroad that my dad worked for years ago. And the money was being sent to me. So of course I started spending the money, nothing frivilous, I paid my Moms funeral, and everyday live things, when I first started spending the money there was 20,000 in the bank, so after spending 40.000, I was charged with a felony, and would get no more ss checks

Your question is very complicated. You should not try to get answers online. You are charged with a felony and need to hire a criminal defense attorney. As for what "they" told you, its what is in writing that really matters. If you just spoke to someone at the 800 number, those people are extremely unreliable. Also, it will be hard for you to prove the contents of any phone conversations you had with anyone. Did you write any letters? return any checks? Good luck.

You need to consult with a criminal attorney. You are faced with felony charges presumably fraud and theft. An attorney can defend the charges as appropriate and advise you how to proceed. If you cannot afford private counsel, contact the Public Defender right away and no later than 10 business days before the court date. Your biggest concern right now should be avoiding jail time.

He should consult with a local attorney. Federal prosecutors like to make examples out of cases like this because it is so easy to turn these lame excuses against the defendant. Use of the internet is also not recommended because on no confidentiality. "So of course I started spending the money..." is an admission. Federal time is hard full time.
"Your" entire check? Why were you on your mother's account? You need to see a LOCAL attorney who does both Social Security and criminal defense work. I would recommend Robert Silberman, who is in Camp Springs, and an expert in both.
