If he did not know what was going on and did not serve as a lookout, then he is not guilty of the offense. If he drove the getaway car then he can have a problem because of that. However, it will be hard to show this unless the other kids agree that he was unaware. Perhaps this is not a group he normally runs with? Or one of the kids has a record or bad reputation? He is an adult and he needs a lawyer.

They could try to connect him under a conspiracy theory. However, it is a positive that he never entered the premises. Hopefully, his attorney can seek a reduction to a misdemeanor under a lesser included charge and/or dismiss it somehow. More facts are needed and obviously your attorney will have to investigate.

Bottomline: You need to hire a local criminal defense attorney to handle this case, because burglary of a habitation is a serious felony offense. While he may not have broken the window, he was still there. Therefore, it is highly unlikely that the charges will be dropped. However, an argument can be made for a reduction to criminal trespass which is a misdemeanor and he should shoot for deferred adjudication if this is first run in with the law. Either way, you need a lawyer to handle this situation.
