How can I get a clear title for an atv after Bankruptcy?

4 views 4 answers
I filed for bankruptcy in 2006. It has been discharged. I have 2 atv's that I had financed thru HSBC. I went thru the process with the lawyer to 're-affirm' the loan w/ lower terms so we could keep them. I made several payments per the re-aff & then found out that HSBC had never agreed with the lawyer's requested terms & I was not made aware of this. I was told by my lawyer to stop payments & hope HSBC would not claim the atv's. 2014 & I still have them & have never been contacted. I Live in Arizona. How can I get a clear title for these & can HSBC still pursue?

Pay off the balance due. Bankruptcy does not extinguish liens. All you can do is call and ask.

Since you still have the vehicle, see if the DMV laws in your state provide for issuance of a title for an abandoned vehicle. Hope this perspective helps!

Unless you pay the balance HSBC still has a security interest in the vehicles. You can call and see if you can offer them a settlement amount and get the vehicle titles.

You probably will not be able to get a clear title because you didn't pay off the loan. HSBC probably won't release the lien, but they probably won't repossess the ATV's.
