Asylum interview postponed

3 views 4 answers
My asylum interview was set for today. I went there and they told me they had to postpone my interview because I didn't submit my declaration(affidavit) with the I-589 form. How common is that? Am I going to wait for another year for a reschedule?

That is uncommon. An asylee need not necessarily to submit a declaration or affidavit in advance. The application and the information within it should be sufficient but I'm California any thing is possible.

If your I-589 or accompanying personal statement did not contain a statement relating the facts giving rise to your reasons for seeking asylum, the asylum officer would have no basis upon which to adjudicate the asylum application. Maybe this is why your interview was continued rather denying it outright. Postponement of the interview can delay your case for substantial periods of time, depending on the particular asylum office.

Well it is quite common to reschedule interviews, particularly when the application package is incomplete. The waiting period depends on when you file the statement and when they can schedule your case.

This isn't common. And you will probably have to wait a substantial period of time for another interview. You have become another cautionary tale of why hiring an attorney is always in your best interest.
