A Rule 5.2 Certificate is a certificate of service, but is specifically related to discovery requests. We typically use a 5.2 certificate and a Certificate of Service when serving discovery requests/responses. For Motions we just use a Certificate of Service.
There is a difference.
Many documents require a certificate of service (motions, answers, entry of apperance, etc).
A rule 5.2 certificate is for a specific type of document as to service of discovery:
Rule 5.2. Filing requirements.
(1) Depositions and other original discovery material shall not be filed with the court unless or until required by the provisions of O.C.G.A. § 9-11-29.1(a) (1) (5).
(2) A party serving Interrogatories, Requests for Production of Documents, Requests for Admission and Answers or responses thereto upon counsel, a party or a non party shall file with the court a certificate indicating the pleading which was served, the date of service (or that the same has been delivered for service with the summons) and the persons served.
Rule 5.2, in Georgia, refers to the Uniform Court Rules. The rule regarding certificates of service is the same in State Court and Superior Court. Likewise, I always include a certificate of service in Magistrate Court cases, as well. On the Certificates of Service that I have filed my entire career, I do not expressly mention Rule 5.2 in my certificates of service. Keep in mind, assuming you are not an attorney, that I would get my certificates of service notarized, because they are supposed to be sworn affidavits of service.
