I don't know if it's worth taking to trial, but it's definitely worth having a personal injury attorney involved.
After a week, if your girlfriend is still hurting, she may be hurting for some time. DO NOT deal with the insurance companies on your own.
Get a lawyer.
You are putting the cart before the horse - you only go to trial if you can not settle with the at fault driver. You need to continue your and your girl friend's medical care and see an injury attorney ASAP. Do NOT try and deal with the insurance companies on your own.
First things first. take care of yourself medically. Be both honest and thorough on what hurts, how bad, etc. Do not embellish, but do not minimize either.
Second, do not talk to anyone about your matter except your medical issues to medical providers until you secure the services of experienced personal injury counsel. This includes the other driver, the driver's insurance folks, anyone where you did not initiate the contact. And do not initiate contacts that counsel does not know about and approve in advance. Let counsel guide you and protect your interests. No one on the other side of the wreck has a greater priority than to minimize your compensation.
Third, when injured parties do not diminish their own claims up front, it is very common for matters to resolve without going to trial when liability is clear and damages are properly documented. Your retained counsel can explain this to you in detail.
Hi Shawn. You did the right thing by going to the hospital. You need to continue to get medical treatment. You should also find a lawyer immediately. You may not need to go to trial if the lawyer is able to settle the case for you. I hope you and Tammy start to feel better soon.

The time to seek help is now not once everything is okay. You should obtain needed medical care and treatment immediately and follow the doctor's advice. Do not give any statement to the adverse party or insurance company nor grant them access to any medical records. Photograph the injuries and the damage done to any property. Contact a personal injury attorney in your area as soon as possible so that you can protect your rights. You may also find it helpful to review the Legal Guides I have published on .com dealing with many of the issues you are now facing. The Guides can be accessed through my profile page on .com.

If you haven't already done so, it sounds like you and/or Tammy should probably consult with a qualified personal injury attorney right away. The initial consultation with the attorney should be free and you can then figure out what your (and Tammy's) options are moving forward. The attorney can assist you with navigating the sometimes very complicated and confusing world of insurance companies, hospitals, medical doctors, car repair facilities, rental car companies, etc. Best of luck to you both.

Shawn, make sure you both are getting appropriate medical care. Some of it will be paid by your own PIP insurance. Then see a lawyer. You may be competing with the occupants of the car in front of you for limited assets/insurance coverage.
Trial? no one knows, it is too early to tell.
