How can I Baker Act my sister? She is killing herself and destroying my niece's and nephew's emotional well being.

My sister has been placed on a concoction of medications that is destroying her health and the emotional state of her children. She has been diagnosed with partial schizophrenia, bi polar, and manic depression. She has a psychiatrist that is just prescribing and not doing much else. Ever since she was put on these medications she has gained so much weight and can hardly breath. She has recently been put on oxygen at night to help her breath while she is asleep. All she does is lay around and sleep, she hasn't bathed in over 6 weeks. She has had DCF called on her many times, they do nothing. She is killing herself and not even caring. I have tried to talk to her and have made appointments with counselors, she has never went. I do not know what else I can do to save her life.

I am an attorney licensed in the Commonwealth of Pennsylvania, and the States of Delaware and New Jersey. My practice includes employment, business and health care law. Before I respond to your inquiry, I must state that we have not spoken, I have not reviewed the relevant documents and facts, and I do not represent you. Therefore, my discussion below is not a legal opinion, but is informational only. Finally, my discussion applies only to issues to which Pennsylvania, Delaware, New Jersey or Federal law applies. That being said, you raise a number of issues - not only involuntary commitment, but whether you should attempt to gain guardianship over your sister, and who will be legally responsible for her kids (if the father is not in the picture). You need to speak to an attorney ASAP who has experience in these areas, as you cannot get a complete picture of your legal position on this complicated an area on . /Christopher E. Ezold/
