My son was bitten by the neighbor's dog a year ago while they were playing. My stepson witness it and said that's how the dog plays and my son didn't cry. Our son told his dad in front of me that it didn't hurt and he didn't bleed. Out of spite his father wants to report the dog, because I reported his mother's dog for biting our son on his cheek, causing him to bleed and cry. Our son complains that grandma's dog is a mean dog. Our son loves my neighbor's dog. Does his father have a case? To be clear, I'm not asking for the grandma's dog to be put down, I just want it on record, because this is the second time in two years that the same dog bit and cause our son to bleed. First time was on his nose and I didn't report it then, but I am now. Thank you for your time.

I cannot follow the question. But, generally, the owner of a dog is responsible for any damage that it does. However, without any real injuries, there is no case to bring. It is not a criminal issue, and the victim cannot compel the destruction of the animal.

Without damages, your husband does not have a viable claim. I do suggest that you discuss the bad dog situation with your child's grandmother. You have 2 potential claims against his grandmother.

This would not be a strong personal injury case because of the lack of damages. Until you find an attorney in your area to advise you, I would not let your son around the dog.
