I just got charged with 3 misdemeanors. Can I go into treatment instead of jail time/ probation?

I got charges with domestic battery, disorderly intoxication, and resisting arrest without violence. The battery was with no bodily harm- I was just trying to grab my keys from my fiancée because I was drunk and she took them, when a cop drove by and saw us arguing and me trying to get them. I am an alcoholic and have a few mental illnesses. I really need treatment and the day after I got arrested I already researched where I can go for help. Will the judge let me go into treatment instead of getting jail time or probation? Can my public defender make that type of deal with the state attorney's office before my court date? Will I have to wait for the court date to go into treatment or should I go now?

These are all questions for your public defender. They are familiar with your case, your Judges and the protocol in your local court. Talk to them and the proceed accordingly. Good luck

Don't take your chances. Take advantage of a free consultation at a local criminal defense attorneys office for all of your options. Do not make admissions on this or any other public forum. Domestic violence simple battery is punishable by up to one year in jail and even if adjudication is withheld, you may not seal your arrest and court records. A criminal defense attorney may help you plan a strategy that will result in the dismissal of all charges. Then you might be able to expunge your arrest and court records and you can also arrange for the treatment that you need without risking jail time and a criminal record.

If you have no priors this is a reasonable resolution to your case. Expect to be placed on probation during your treatment. Make sure you have a letter of acceptance from a treatment facility, give it to your public defender. Also get a letter from your doctor regarding your mental illnesses.
