Applying for OPT extension

4 views 3 answers
Hello I am on my OPT and will be applying for a STEM extension. I need to leave to India on Sunday on a very important trip that cannot be postponed or cancelled. Right now it looks like I wont be able to get all the documents needed to mail USCIS before I leave, but they will definitely be ready by next week. My question is, can I go ahead with the travel plans and have someone just mail the documents for me? I will sign the documents that need to be signed before I leave. I am worried if my leaving before actually applying for an extension will cause any problem. When I return, I will still hold a valid OPT and hopefully a receipt for the extension.

A risky proposition since the law is very unforgiving to untimely filed extensions. You better go beyond signing and all, and make sure that every bell and whistle of the application is correct.

Yes, that plan should work if everything is properly prepared and finalized, with the I-765 completed, signed and dated & ready to be mailed, only subject to the missing documents. Make sure.

You can go abroad. But do you have a guarantee that the person will mail out the documents. Make sure your friend sends them out with proof of delivery.
