Got hit in hit and run, should I press charges?

I was barely rear-ended about a month ago, the only damage to my car was some smuged paint. However, when I got out to confront the guy, he took off. I got his license plate, and called the police. They have asked if I'd like to press charges, or just get restitution. As I said, there wasn't any damage, to the point that restitution isn't even needed. However, my daughter was in the car, and though we were both fine, I was pretty furious that he just took off. Should I press charges against him for hit and run? Would I need to hire a lawyer? Besides him getting in trouble and his license possibly revoked, what would happen? Would it be worth my time and money hiring a lawyer if I have to?

You should not need to hire an attorney if all you want to do is punish the guy. Just let the prosecutor know that you want to press charges. You may have to testify against him, but shouldn't have to do too much more. I'll change the practice area to get you more criminal law based answers. Good luck. Glad you're ok! If you or your daughter begin to have any symptoms, be sure to get checked out by a doctor.

If you and your daughter weren't injured, it probably wouldn't be worthwhile to sue. The prosecutor's office makes the decision about whether to charge a crime. If they want you to testify as a witness, they'll call you.

I agree with my colleagues, prosecutors will make a determination. Good luck.
