I 'm currently on H1B and married this woman from India 2 years ago and brought her to US on H4 visa. She never consummated the marriage and despite of that she made me bankrupt after 1 year and ran away from my place. We are currently living separately. She applied change of her visa status to F1 and now started working on CPT by joining a school. She married me only to circumvent the immigration laws, so that she could start working on CPT and later on H1B too. What should I do in this situation now ? If I apply for divorce, she would start asking for alimony and I hate to give out my hard earned money when there is no mistake with me . Can I report this woman to USCIS ? Thanks

You could petition to invalidate the marriage (annulment) but you must speak to a lawyer first about any potential liability in your part... Depending on the circumstances of your marriage, your married life and another factors you could be exposing yourself to criminal charges for marriage fraud. Discuss your options with an attorney who has knowledge of the criminal elements of marriage fraud and has experience defending persons who have been so charged. It's a fact specific question and you should not talk on an open forum. That's very important - don't talk to anyone other then a lawyer and don't provide details on a public forum

Where did the marriage take place? You may have to talk to more than one lawyer considering your non immigrant status. You may be subject to jurisdiction of more than one state/ country.

I posted an answer to this exact question in an earlier post. Please refer to my post to your question. Best of luck. Yes you can report her to USCIS, change all your passwords, and call your credit card companies. Along with my other suggestions in my earlier post.
