I-539 COS filing (L1A to H4) sent to wrong USCIS center

Hi - My current status is L1A and changing to H4 based on by Spouse H1B. I was in valid L1A status ( in US payroll) till 8/4/2014 and L1A petition/I-94 is expiring on 8/17/2014. The I-539 documents ( based on my spouse has approved I-797 H1B) were filed to Vermont center instead of Dallas lockbox on 7/31/2014 and the documents reached Vermont center on 8/1/2014. Later I realised that I should have sent it to Dallas lockbox as my spouse I-129 is already approved. On 8/8/2014, the $290 debited from the bank account - USCIS DALLAS DES:PAYMENT ID: 0176 INDN: PJPMC1142190003922 CO ID: ********** CCD. I'm not sure and confused whether I can assume the documents are forwarded to Dallas lockbox or should I re-file the documents to Dallas lockbox as my I-94 end date is on 8/17/2014. Pls advise.

When file at the wrong address CIS does not usually "simply forward" an otherwise correctly prepared and feed application back to the right lockbox or service center address - within 10 days or 2 weeks or so it returns the entire package back to you. Wait until you receive that package back, then resend to the right lockbox address. Your I-94 is only expiring on the 17th. Otherwise, if you are too nervous and feel that cannot wait, then immediately send another original I-539 package to the lockbox early next week, via courier (FedEx or UPS) with tracking number and signature request.

Unfortunately you can not be sure what USCIS have done with your case without investigating it further. Have you tried calling the customer services number or alternatively setting up an infopass appointment to try and find out what has happened to your case. It is possible that they have forwarded your case but I think the more likely scenario would be them to return it to you. As I mentioned I would investigate the matter further. You should never assume anything.
