I,ve had a dwi pending since 2/15/13. Im going again on 8/18. It will be my 8th appearance. Surely this is grounds for a dismissal. I took no field tests, no breath analysis. The states case hinges on the blood work. But in the mean time I cant acquire gainful employment to support my family due to this pending charge. We,re close to losing it all. What recourse do I have because we cant make it like this another month. Thank,s Mike. Davidson County,NC

That's not that old in NC. Blood is taking a LONG time to be tested.

DWI blood cases can often be dismissed (with leave for the state to refile) at about a year or sometimes sooner if you have been available at each court date. Talk to your attorney about pushing for a trial, but rely on whatever your attorney advises as they know your particulars better than we.

You did mention whether you have employed an attorney. If so, consult with your attorney about steps to take to push this case along. Labs on blood work do often take a long time, but if that evidence isn't produced, perhaps you should seek your attorney's counsel on the merits of setting it for trial. Good luck
