My recent death of my life partner has made his exwifes daughter to lie to police and they let her enter my home while I was away. When I tried to make a criminal report the true niece joined her case and now my probate lawyer sais I can't file a criminal report on the one who entered my home by lying and no judges proper documents.

This sounds like a no-win situation and you do not ask a question that I can understand.

If you have a lawyer and are in the probate court, you don't have to try to push for criminal charges. You should work with your lawyer to build a case on what you have lost. In a probate context, if a personal representative or a nominee for personal representative of an estate in Alaska, for example, has provided false information to the court, that person is disqualified from serving as personal representative and can be removed. You would have to file your petition under a formal probate procedure. My advice: speak with your lawyer, if you can show that deception was used in a manner that caused a loss, that will assist you in making your claim.

I agree with Mr. Watts and hope you can follow his suggestion. If you need an atty: Go to .com, find a lawyer and put in the specialty area and your geographic location and attorneys should pop up. You can call a few and see about prices and availability.
