My Son was selling Bitcoins (digital money) started in Japan. Some of the people used bitcoins to buy drugs on Silk Street on the internet. He is being charged for money laundering which is very untrue he has no money and is broke

One need not make money on a money laundering scheme in order for the court to find one guilty of money laundering. In federal criminal court, you don't find out what evidence the Feds have against you until you go to trial, and the sentences depend on how one "scores out" on the federal guidelines. The judge has discretion to depart from the guidelines, but frankly, everyone wants a downward departure, yet very few get one.

It depends on where he falls mam in the Federal score guidelines. Did he cooperate with government for example? Best to call his assigned federal prosecuter who would better know that judge and his prior sentences.

The short answer is...maybe. In Federal Court it depends on where he scores, based on many different factors. You do not plea bargain for a specific number of years. Ultimately every sentence is up to the presiding judge. Not sure why this was posted as a Florida criminal defense question. May be more appropriately directed to his attorney is New York or his Federal Public Defender.
