If I fail a drug test on Community Control, is there a chance I won't go to prison?

I tested positive for Meth at my probation appointment and i'm on CC. I've battled with drug addiction for years and have been begging for help. Is there a chance I can go to rehab? Is there a chance that my po won't violate me? She said when I left the office to continue to follow my schedule and that she wasn't sure if I was going to jail, that she needed to review my file to see.

you are in deep trouble and you know it. you should retain an experienced criminal trial attorney right now...before you are violated...in order to have the best chance of obtaining the result you are hoping for. you need to be evaluated immediately for an appropriate treatment program which is much more difficult to accomplish while you are sitting in jail with no bond. good luck

Begging for help or begging to be in prison? Probation is a gift. CC is a form of probation. You now need to get an attorney to avoid potential prison, because you can be sentenced to the original amount of time you were facing before you got sentenced to CC. Yes, there is a chance that you can go to rehab. Have you taken any steps whatsoever to get into it?

In y experience dealing with these type of cases on a regular basis, the PO will violate you. However, I do not have enough of your history to commpletely answer your question about jail. If you are violated unfortunitly you will have to go back to jail unless you hire an attorney that may be able to walk you into the court plead your case and deal with it that way. Options? An attorney can get you privatly evaluated by a doctor or theripist in order to mitigate your sentencing, they can also help with the medical expert to try and get you a bed in a residential program, these are just options, again I do not have enough of your history to say for sure, the best thing you can do is hire an attorney ASAP, get a plan going, and then professionally present your case.

Start going to NA meetings immediately and if you have the means try to get into a rehab center. You need to speak to an attorney ASAP.

You are almost definitely going to be violated. Whether the State is seeking prison for the violation will depend on what you are on CC for and what your criminal history consists of. It is in your best interests to retain a lawyer sooner rather than later because your attorney may be able to negotiate with the probation officer. In the meantime, start getting drug counseling to show that you are making a good faith effort to fix your mistake.

The likelihood of going to prison is very high however there are some things that you could do to reduce that risk. If you can get into a rehab or get on a waiting list to a rehab it would help significantly. Your probation officer has likely submitted an affidavit of your violation to the judge and is simply waiting on his signature and a warrant for your arrest. You need to act quickly so that your lawyer can argue for your release into a rehab program that you already have in the works.
