What steps do we need to take for my husband to adopt my daughter?

My daughter is almost 5, and I don't know who the biological father is. There is no father listed on the birth certificate. My husband and I have a child together also and he has raised my daughter since she was 8 months old. What does my husband need to do to adopt her? We live in CO but no longer live in her birth city.

You will need to file for adoption with the Court. This will likely require an explanation of the reason that you cannot identify the father and notice by publication of a summons with a John Doe designation. This can be somewhat complicated and it would be a good idea to retain an attorney to assist you.

You may have to take steps to notify any potential father of your daughter. If this is not possible, your husband would file a petition to adopt and you would file your consent. The court may require that you file a petition to terminate the rights of "John Doe" and any possible fathers. You would publish in a newspaper to satisfy the notice requirements. This is best done with the assistance of a skilled family law attorney who handles adoptions.

you would need to file a petition for adoption in your present location. There are specific requirements surrounding the adoption such as criminal background checks and notice to any potential father which in your case would need to be done by publication. It can be a minefield so you would be best served by retaining an experienced family law attorney.
