Can a defendant sue for damages if they win a parking ticket on appeals.

I received a parking ticket at Long beach State and I lost both by initial request and the administrator hearing. The administrator referenced a cvc code which I was not issued the parking ticket for cvc 21113 (b) as reason for finding me guilty. I appealed the decision in court and won. (Long Beach state did not reply) Since I won and I feel the ticket was faulty I was issued a citation for cvc 21113 (a) not displaying a permit which the definition of cvc 21113 (a) has nothing to do with parking permits. Can I sue Long Beach State for my incurred costs to fight the ticket?

There is a judicial privilege that would prohibit such a lawsuit, in my opinion. Your victory is all you will be able to celebrate.

I agree with Mr. Gross that you cannot sue the City under these circumstances. There is something called "governmental immunity" which prevents these suits except under VERY limited circumstances. You did a great job in beating the ticket on appeal but that's as far as it's going to go.

NO, you canot sue Long Beach State. Be glad you won and move on with life. That's a lot of fuss over a parking ticket.

I agree with my colleagues taht you cannot sue for "damages". But you do have the right to an award of court costs - filing fees, cost of service of documents, etc. - as long as you file the correct forms ina timely manner.
