Signed up for dui classes. Wondering about the drug testing because I will have weed in my system from medicinal use. Even stopping now won't get it out of my system in time. It stays for up to 3 months sometimes. I used it legally but now that I'm in the course im concerned they will fail me due testing positive. I don't know what to do?

Have you talked to your lawyer about your concerns?

You should speak with your attorney about your situation. If you have a prescription for the medical marijuana, then you should take it with you to your testing and for your fie to be documented. Normally, prescription drugs are exempted with proof of a valid prescription.

DUI classes generally do not test for drugs. However, do not show up for class stoned. The class can certainly still call the police on you if they suspect you are under the influence.

You should consult with your lawyer about this issue. Most times, if these issues are brought to a probation agent or judge, with a proper explanation and documentation, worse consequences may be avoided. It obviously depends what the DUI charge is, especially if you are charged for DUI (under the influence of drugs). I am not saying teh court may excuse it, but if you are using for medical necessity, you should consult a lawyer as to the use of that information in court.

More information is needed to properly evaluate your situation. For example, is this a first DUI or do do you have priors? Is this a misdemeanor or felony a conviction? where you placed on formal or informal non-supervised probation? Are all very important questions that must be answered to determine the likelihood of you being tested for drugs in your DUI class. drug testing is typically not done in misdemeanor level DUI classes. If there is testing, it will be in frequent and random. In some instances, it is better to disclose your recent marijuana use so that it does not appear as though you used while on probation and while enrolled in the DUI class. This is especially true if you are on formal supervised probation. Definitely set up a consultation with an attorney to assist you on the best course of action.

The DMV first offender program doesn't test for drugs. However if you show up under the influence they will terminate you from the program giving you a probation violation. If it is a separate testing program speak with your previous attorney.

In my experience, the First Offender Program does not test for marijuana in California, but this could always change, so you should consult with an experienced DUI attorney. Do not show up high to the meetings, or they will kick you out of the program.

AB541 also known as "first offenders" or "3 month DUI classes" is where you usually meet once per week for 1 1/2 hours - this class can help you get a Restricted License after only 30 days of suspension and is also one of the things that most California DUI's require. YOU DON'T GET TESTED FOR DRUGS AS PART OF THE DUI CLASSES, AND NOT EVEN AS PART OF THE 3 YEARS DUI PROBATION THAT THE COURT WILL IMPOSE ON A FIRST DUI. That's an informal probation which basically means you cannot drink a single drink and drive for three years or you risk picking up a violation.
