Anything is possible and it really doesn't matter if other cases like the one describe were dismissed does it? What matters is: Will your case be dismissed. Who knows? You need to retain a very skilled and experienced criminal defense/DUI Attorney without further delay. Chances are, the case won't go away easily--given your history. The tail will wag the dog no matter how strong or weak the evidence.

Anything is possible. It is not likely this will end in a dismissal, but you still need to get an attorney to be sure and, if it does come to sentencing, to try to mitigate the fallout. You are facing serious consequences, if convicted.
A DUI case can end in a dismissal depending on a number of factors. It just depends on the facts of the case.
As it stands, you are facing a minimum mandatory 90 days in jail if convicted for this third offense. The penalties associated with a DUI conviction are steep as it is (loss of license, fines) - jail sentence only makes things worse, especially when it comes to work, family, etc.

The only way you will know if your case will be dismissed, it to discuss it in detail with a good DUI attorney. I've had DUI cases dismissed for a variety of reason, i.e. bad stop, errors with the breath test, etc. Call an attorney in your area and discuss the specific fact pattern and an and they should be able to give you a better idea concerning your options. Good luck!
