In CO, can I press charges against my 12yr old daughter for stealing her stepfather's tablet? What will happen if I do?

She had her own tablet (and our family laptop) confiscated by the local police when she was using Skype/Facebook/etc to produce, possess & distribute pornographic materials of herself as well as receiving pornographic material from numerous men. Last night we found that she had taken an old tablet of my husband's that no one was using and had begun the same behavior using this. We are struggling with how to keep her safe & are hoping a stay in a detention facility might help?
Why would you want to press charges against your daughter and have her put in a detention center? The smarter and better parenting move would be to have her see a professional to figure out why this is happening and how to treat it. Perhaps a child psychiatrist.
Speak with a criminal defense attorney that handles juvenile matters to give you some guidance before you do anything that could involve your minor daughter in the criminal justice system. It is illegal for anyone to posses or distribute pornographic images of minors, and that includes the minors themselves. It does not guarantee prosecution, but minors often are prosecuted. The situation is certainly serious, however, there are many different interventions you can and must consider before any form of detention for a juvenile, which is an often draconian solution with sometimes life-changing ramifications and usually for the worse, not the better. Best wishes.
In our experience, juvinile detention can exacerbate any criminal behavior. As a parent, it seems that a scared straight program or counseling would be more beneficial to her. You should be careful that she doesn't put your husband in crosshairs of posession of child pornography.
