Toxic tort.... Is it too late?

Personal Injury 5 views 3 answers
My father worked in hazardous waste removal for many years. We believe he was exposed to arsenic on one job (which the employer denied the BWC claim for contact dermatitis). Most of his health conditions fit those relating to long term arsenic exposure, including blistering of his hands after cutting his finger nails (14 years after exposure).**all research I've done says the nails only last for a few months** No doctor has diagnosed him with anything relating to arsenic exposure and the power plant he was working out of has since closed. I know with toxic torts there is the statute 2 years from finding out you're injured as a result of the exposure.... With no point blank diagnosis of "arsenic exposure" is it a viable claim or too late?

Without a diagnosis I do not see how your father could pursue any kind of claim. Medical causation is the first step.

He needs to get diagnosed by a doctor, and a local toxic lawyer can investigate. has a great lawyer finder tool to locate an attorney close to your home. Good luck.

First, has he had a blood test by a reputable lab to detect arsenic or heavy metals or other poisons in the blood? For any claim--workers comp, someone else at fault you need to show that what you have is due to work so either someone can show he has some type of dermatitis frequently encountered with people in his line of work or that there is a diagnosis of poisoning and it is from his job not something else (for instance handling pressure treated lumber).
