Is landlord liable for cockroach eradication?

Real Estate 7 views 1 answers
I placed in my lease agreement that cockroaches existed. The landlord treated once but they still exist. Landlord now saying my responsibility for eradication. Nothing in lease stating I am responsible for eradication of pests, especially pre existing. Doesn't this come under an implied warranty of habitability and my to enjoy my property?

The landlord' responsible for the habitability of residence. This normally does not include eradication of pests. If the infestation is the result of a condition of the property itself, then the landlord would probably be found responsible if the issue were brought before a judge. However if it's because you're leaving your food out... There are bugs of some kind in absolutely every else. if you knew there were bugs, you could've/should've insisted on a lease provision that required the landlord to provide pest control. This will be very fact specific if it were good to go to court. You would have to show that the property itself was defective to the extent that eradicating the past through normal extermination would be insufficient.
