Contractor was fired and left tools behind (plus a TON of rework that will require new expense) - He has missed multiple appointments to pick the tools up, and generally been very belligerent and almost threatening. Beyond the nuisance, the attitude has made us wonder if it will be safe to have him over at our house again. In WA state, is there any process we can follow to safely just get rid of them or maybe recoup some losses on all the rework needed if he continues to be a no-show?

Give him notice in writing that you do not want to hang onto his tools/property. Tell him his choice is to come get it, or you will take it to a storage place in 30 days and give him the key (or the access code) and he can pay the storage fees. You need to speak with an attorney who handles construction matters, so I am changing the practice area. Elizabeth Powell

You should retain a local attorney whose practice is concentrated in construction law. The attorney will want to review your contract with the contractor and if no formal contract, then any writing between yourselves which define and outline the scope of work. You will also want to retain another contractor, to at least provide you with an estimate as to the remaining scope of work including any repair/remediation of the first contractor's work. Your measure of damages will be based upon the cost of completion of the outstanding work including the repair/remediation. But again, review with a local attorney will provide you with the opportunity to review the details and be provided with your options.
