City, state and county all 3 says different things each time we go to ask questions. At first the probation place said they didn't even know what he stayed in jail for 32 days for, now they are trying to charge him with same charges again, have a hold on him and can only get out with a $460 cash bond only He was told all charges were combined together that's why he did the 32 days. Are they trying to charge him with double jeopardy? What can we do to help him? Please help us!!!
Why are you asking questions? It is your friend's lawyer who is handling this. If he doesn't have one and is relying on friends, it might explain all the trouble he has been in. If you want to help, loan him money for a lawyer and don't interfere.
The best way to know what happened with his case is to get a copy of the disposition that way you will know if your friend was serving 32 days for two cases concurrently. You can request that at the clerks office in the courthouse where he was sentenced.
I would get a copy of the disposition and take it to an attorney for review. The attorney will be able to give you an accurate overview of what your friend served time for.
Your information that you provided is shoddy at best. No one can possibly answer your question without ALOT more information. You have told us that he has been in jail and has a bond amount. You have also inferred that he has entered a plea? Double Jeopardy would not have attached until he either enters a plea or jeopardy actually attaches. You seriously need to have your friend either contact and attorney or talk with an attorney that is not a "friend."
No. This is not double jeopardy. We can't answer this question without knowing more. The sheriff of the county calculates the time spent in custody. I'd get a copy of the judge's sentencing order, and start there. That will state what is supposed to happen.
