Who pays taxes after divorce?

NYC been separated and apart from ex since Feb 2010 I did not work. We signed Temp Agrm on May, 2013 (where it states that my ex is paying lump sum incl ch sup & alimony). We signed Sep Agrm in Aug, 2014 (were it states that my ex is paying ali & ch sup) Filled taxes married jointly. My ex got IRS bill after that we owe $35K for 2013. He paid to avoid late fees but now demanding for me to pay half $15K. He is also saying that we owe more taxes on 2012 as well and he wants to me pay that too. Am I responsible for 2012 or 2013 taxes? Or not? How much of it? Thanks, Irina.

One could only hope your final agreement addressed the issue. If it didn't, then from the IRS' perspective, you're both jointly liable. However, if your ex already paid part of the bill, it's unlikely he'll be able to recoup that from you unless the agreement says otherwise. Schedule a consult with a NYC Divorce attorney for a full assessment.

Unless your separation agreement states that you are responsible for half of the amount of taxes, he cannot force you to pay anything, especially if you were not employed during that time. These issues should have been addressed when you negotiated your agreement.

These issues should have been addressed in the divorce case and included in your settlement agreement.

In all agreements our clients sign, there is a part that indmnifies our client (protects against) against any debts or tax liens. Talk to your attorney and find out whether it is in there or show it to an attorney to better guide you.
