Opposing counsel trying to get my WORK COMP records using Cohan v. Ayabe for DIVORCE case - does case only apply to work comp?

We're claiming HIPPA/constitutional rights to privacy and that opposing counsel is just fishing without substantive grounds to obtain said records.

Since the case you cite is a circuit court case, it could well be applicable beyond work comp, but the opposing party would still have to show how obtaining the medical information over your objection is relevant to the underlying litigation, which in your case, sounds like it is a divorce. At any rate, it sounds like you have an attorney, and he or she would be in the best position to analyze this issue for you, and advise you or your rights. You should consult your own attorney first. Best of luck to you.
