I want my money back

8 views 2 answers
I retained a new lawyer as my old lawyer was, I felt, incompetent. The last straw was my last court date. Previous to court starting, when I expected to talk to my lawyer, he went off to talk to my husband's lawyer. When the judge questioned why the case was taking so long my lawyer blamed me for the lack of momentum in the case. There were bills to be presented related to the case that were not presented in court nor afterwards. I was asked in court for paper work that I had turned in two months previous. After the judge left the courtroom, I overheard my lawyer making a joke about me with my husband's lawyer. I feel I was not represented in my best interest. There have been many other things such as not being able to reach my lawyer. I want a refund.

Write you lawyer and explain your position. Request a statement of billing and an accounting of your matter. If you desire, set a meeting and explain you do not feel it is appropriate to charge you for correcting the issues of your relationship. If your lawyer meets with you, see if you cannot work it out. If you cannot, terminate the relationship, get your original file and hire a new lawyer. Good luck.

Fee disputes with one's attorney may be resolved via the State Bar Fee Resolution process. You can arbitrate the fee dispute. see http://www.wisbar.org/forpublic/ihaveadisputewi...
