Your boyfriend is in trouble and needs an attorney. He is likely charged with Driving While Ability Impaired by Drugs ("DWAI"drugs") in violation of Section 1192(4) of the Vehicle and Traffic law. DWAI drugs is a misdemeanor and even if this is his first offense, he faces a maximum of one year in jail, a fine of up to $1,000, and the revocation of his driver's license if he is a New York state license holder. You report that the car was off and parked in the median of a highway. The engine does not have to be running in order for a person to be found guilty of this offense. Much will depend upon the report of the arresting officer and the facts surrounding the arrest. Your boyfriend should contact an attorney in Westchester County who handles DWI and DWAI cases and is familiar with the town or City court where the case is pending. Good Luck

It's a very serious matter. There are a wide variety of direct and indirect penalties he faces. First of course is the potential for up to one year in jail and $1000 fine and the possibility of a permanent criminal record that cannot be expunged or erased, which could translate to lost job opportunities. Then there is the loss of driving privileges, the potential loss of vehicle to forfeiture, alcohol counseling, DMV driver responsibility fees, court costs, insurance premium increases and if convicted of the misdemeanor charge he will have to install and maintain an interlock device in his vehicle for one year after sentencing (they are expensive). As you can see, this is one of the worst misdemeanor crimes that anyone can be charged with in New York. Your boyfriend should be seeking an experienced DWI lawyers help ASAP

It is certainly something that he will need an attorney for. The outcome will partially depend upon the specific circumstances of his interaction with the police and any tests he took. Speak to a DWI attorney immediately to discuss the case in full.

It's pretty bad when your vehicle is disabled and you are smoking weed waiting for a ride. Sort of reminds me of a Cheech and Chong movie.
