Also filed a dissolution of marriage, basic 146 page from clerk of courts. I am unfortunately having to attend pro se. I have not been aloud contact with my children for two months now. My wife fled to pa with the help of dcf who gave her 72 hrs supposedly to leave state. a false accusation of dv that was no billed by states attorney 3 weeks later. No injuction was put in place against me. I have since through my own investigative work managed to attain her own admission through social networking admitting to being under the influence of drugs and alcohol as well to not having our son in pre k depriving him from an education. I just want to be prepared.any opinions would be appreciated. Thank you

The Florida court should have jurisdiction to resolve the "custody/time-sharing" issues if the children have not been away from Florida for more than six (6) months. If the children have been in "PA" or away from Florida more than six (6) months, you have a much more difficult case to try. In any case, you should prepare for your hearing. Not having funds to pay an attorney or not being represented (for any other reason) is no excuse for not being prepared. Take the time to prepare and outline of the issues and a time-line so you know what happened when. Identify with specificity ALL of the relevant dates and what happened on each date. If you need someone's testimony have them accompany you to the hearing, or subpoena them to appear because you WILL NOT be able to relay what they told you (that would be hearsay, and not considered by the Judge).

You need to obtain an attorney. I doubt that your Wife's failure to provide an education at the pre-k level will be the dramatic turning point in your case. Pre-K is not mandatory.

I have seen your question in various different forms on this website for the past 3 weeks. Why don't you retain an attorney to assist you. No one on this website has a magic answer for you. Find one in your area and meet with them ASAP. Good luck. Sincerely, B. Elaine Jones, Esq.
