Can people have and use nude photos withot permission.

mny years back my gf(now wife) asked me for a nude photo. I texted one. We were both adults. Last night my mother in law told my wife that she and her aunt had the photo if there was ever a problem in our marriage. We have no problems and are both disturbed that she even has them. I sent it to my wife and her only, and she did not pass it on. My concern is that my mother in law had my wifes ex husband falsely arrested when they werent getting along. He won the case and successfully sued her. Point being i am worried about what she may be planning. Before we knew about the photo i had asked her to stop calling and texting my phone because she was trying to interfere in our marriage. So i know she is already mad at me. Is there anything i can do?

Absolutely there is something you can do. Hire an attorney to place legal pressure on the culprit for the return of the photo. Act fast and secure your rights.

Contact an attorney. If these photos were removed from your phone or if your account(s) was hacked in order to snoop and steal items, then the person who did so may be subject to criminal liability, and certainly civil liability as well. Of course all of that is super complicated when you are talking about family members. If there's a way to discuss this amongst family members and work this out, then, of course, that's the best possible solution (return or deletion of photo). If not, at a minimum, I would suggest that you document conversation and any communications you have with your mother-in-law and family members about these events. Some individuals may wish to document it by the filing of a police report (although I wouldn't advise that until you have spoken to an attorney because that can sometimes escalate a situation. An attorney could more properly advise you after having considered all the facts and information -- not just what is posted on a website!). Good luck.

They're not supposed to be able to do this. However, this is one of the many risks that one accepts when placing their personal and private thoughts, images, words, etc. out there in cyberspace. The laws regarding what can and cannot be done are just now being written and are constantly evolving. Perhaps some other attorney will be able to provide a solid answer for you. I, however, cannot. Remember too, though, your MIL may have already disseminated your image to others. Were you to somehow find a way to prevent your MIL from keeping, or worse using the image, you will still always need to be aware that it may still be "out there" floating around.

You're being extorted. But isn't this something your WIFE could handle better than you? Can't she convince her mother to return/destroy the picture? After all, it's HER mother, not yours.

If she didn't legally obtain the photo she can't use it.
