Hello,
I have a satisfied judgment on my credit report from 2009. I received this judgment in New Jersey, but now I live in New York. And according to N.Y. GBS. LAW § 380-j(f)(1)(ii): Judgments which, from date of entry, having been satisfied within a five year period from such entry date, shall be removed from the report five years after such entry date;
So does it mean that this judgment should be removed from my credit report after five years since I'm a resident of New York State now? Or since i received this judgment in New Jersey, it will stay on my credit report for 7 years?
Thank you for your help!
No harm can come of your calling all three credit bureaus to request that it be removed. First, just ask. If denied, cite your support. If denied, reask the question here to see what your rights are.
Contrary to my colleagues' opinions, your simply moving out of New Jersey will not require the removal of this judgment from your credit history. However, you should pull your credit from all three (3) bureaus to verify the judgment shows as satisfied. If incorrect, then you can dispute that status with the credit bureaus, and if they don't timely correct your reports, then the entry must be deleted by law. New Jersey law otherwise governs how long the judgment will remain on your credit, and requires comment by a New Jersey-licensed attorney, which I am not.
I agree with Emanuel. There is no harm in filing a dispute with the three credit bureaus and asking that the judgment be removed. You should cite the statute you mentioned. It will likely take care of it. If not, you may want to see an attorney about your rights regarding this statute and the fair credit reporting act.
