Broker (real estate) won't refund me my deposit for an apartment that I never signed a lease for, what next?

Real Estate 7 views 3 answers
In April/May I met with a real estate broker in hopes of signing a new lease I have her $900 as a deposit (refundable) she then handed a receipt. Things didn't fall through yet she's giving me the run around in regards to getting my funds back. I've made several attempts week after week and she no longer works for the office she did at the time. It's soon to be a year and I don't know if this will affect me from retrieving my funds.

Chances are you are dealing with a Licensed RE Salesperson or Licensed Associate Broker. Try reaching out to the Broker of record to resolve the matter. The Broker of Record is the one responsible for the funds. You can find the Broker of record at this link: https://appext20.dos.ny.gov/nydos/selSearchType.do If this doesn't work your recourse would be to attempt to resolve the matter in Small Claims Court and file a grievance with the NY Department of State.

Dear New York tenant: The fee paid did not land in the broker's pocket and your energy should go to informing the broker's real estate firm to refund the money. If you have records of your futile efforts to engage your broker into a discussion about returning your money, then you should gain restitution from the company, since that is where the money went.

My colleague is advising you accurately. You can also file a complaint with the NYS department of state as they license and regulate real estate brokers and sales people.
