Can an unlawful retainer be served 6 days after the date noted on the notice?

My apts served me with an unlawful detainer via a server who handed it to my significant other who was just coming up to my front door to visit after work at 10:30 pm in front of my apartment. The ULD is over a 3-day notice i received on 1/27/2015 for rent not paid for the month of Sept 2014.$818.00 what should i do? my lease expired this month. I have been having issues with these apts since around Sept. of last year. i didn't pay this months rent to see how long it would take them to cite me and they reacted within 17-23 days. (I know not very bright) . I question the fact that they haven't received my rent because they deposit the rent almost immediately after getting it, and notices go out just as fast

Yes, a summons and complaint for unlawful detainer can be served six days after the date the lawsuit was filed. You need to file an answer to the complaint for unlawful detainer within 5 days after it was served. Usually, if you did not pay rent, it is hard to defend such an eviction. If you did pay rent, you need to say so in your answer to the complaint.

I agree that you absolutely need to answer this complaint. If it was served by substitute service you may have longer than 5 days before they take your default but I wouldn't take any chances. You should also contact the landlord to see if you can pay the rent and have this case dismissed.

I dont understand your question. CA DCA has ample helpful info. https://www.dca.ca.gov/dca/publications/landlor... You can also hire an attorney or simply make arrangements with your landlord to move out.
